Master Terms & Conditions

These Master Terms & Conditions (the “Terms”) govern your access to and use of the ONLIVE School Transport & Parent Platform (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using the ONLIVE Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and Data Policy. These documents collectively form a legally binding agreement between you and ONLIVE.
2. Definitions
- Service: The ONLIVE School Transport & Parent Platform, including its mobile applications, website, and related services.
- User: Any individual or entity using the Service, including Schools, Parents, Drivers, Bus Attendants, School Administrators, and Super Admins.
- School: An educational institution that subscribes to and utilizes the Service.
- Parent: A legal guardian or parent of a student, accessing the platform to track their child’s transport.
- Driver / Bus Attendant: An individual employed or contracted to operate or assist on a school bus, using the respective ONLIVE application.
- School Administrator: Authorized School personnel who manage the Service for their institution.
- Super Admin: Authorized ONLIVE personnel responsible for overall management of the platform.
3. Eligibility and User Accounts
3.1 Eligibility: Users must be of legal age and have the legal capacity to enter into these Terms.
3.2 Account Registration: You agree to provide accurate, current, and complete information; maintain and promptly update it; keep your password secure and confidential; and notify ONLIVE immediately of any unauthorized use of your account.
3.3 Account Types and Roles: The Service supports School, Parent, Driver, Bus Attendant, and Super Admin accounts, each with specific functionalities and access levels.
4. Service Scope and Modifications
ONLIVE provides a SaaS platform for school transport management and parent communication, including GPS tracking, route optimization, student attendance, and real-time notifications. ONLIVE reserves the right to modify, suspend, or discontinue the Service or any part thereof, with or without notice.
5. User Responsibilities and Conduct
5.1 Acceptable Use: You shall not use the Service for any illegal or unauthorized purpose; interfere with or disrupt its integrity or performance; attempt unauthorized access; upload malicious code; or overburden ONLIVE servers or networks.
5.2 Data Accuracy: Users are responsible for the accuracy and completeness of the data they provide.
5.3 Compliance with Laws: All Users, especially Schools, are responsible for ensuring their use complies with all relevant laws, including data privacy laws (e.g. GDPR, CCPA, DPDP Act) and transportation regulations.
6. Intellectual Property Rights
All intellectual property rights in the Service are owned by ONLIVE or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose, subject to these Terms.
7. Data Privacy and Security
Your use of the Service is also governed by our Privacy Policy and Data Policy, which are incorporated into these Terms by reference.
8. Disclaimers and Limitation of Liability
The Service is provided on an “as is” and “as available” basis, without warranties of any kind. To the fullest extent permitted by law, ONLIVE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses resulting from your use of or inability to use the Service.
9. Indemnification
You agree to indemnify and hold harmless ONLIVE, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the Service or your violation of these Terms.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the applicable governing law. Any disputes arising out of or relating to these Terms or the Service shall be resolved through the designated arbitration or courts.
11. General Provisions
Entire Agreement: These Terms, together with the Privacy Policy and Data Policy, constitute the entire agreement between you and ONLIVE. Severability: If any provision is found unenforceable, it will be limited or eliminated to the minimum extent necessary. Waiver: ONLIVE’s failure to assert any right does not constitute a waiver.
